A divorce severs a marriage. To file for divorce in New York,you must first have jurisdiction of
the court. In general, either party must have resided in New York State for one year prior to the commencement of the action, provided that certain other criteria are met.

Legal Separation

There are still many valid reasons to file for legal separation. However, you do not need to be legally separated to obtain a divorce. This is a common misconception.

Mother’s Rights

An unfit parent may seek an award of custody for the wrong reasons. Many mothers have
historically been the victims of financial tyranny and abuse. Traditionally, the husband has been
the primary breadwinner and the wife may be at a financial disadvantage in matters of litigation.

Child Custody

Child custody can be a crucial issue in any matrimonial or Family Court matter. It will impact the life of your child in many ways. Your child’s residence will shape their daily interactions. Simply put, it will dictate how often you and the other parent see your child.

Father's Rights

Either parent can seek an award of custody from the court. There is no longer a presumption of
custody to the mother. The “tender years doctrine” in New York State is long gone. The current standard for an award of custody is “best interests of the child” which is gender neutral.

Grandparent Rights

Grandparents have a statutory right to seek visitation in circumstances where equity would see fit to intervene.  The Court will examine whether there is an existing relationship, whether there have been attempts to foster a relationship, and what could reasonably have been done under the circumstances.
