A divorce severs a marriage. To file for divorce in New York, you must first have jurisdiction of
the court. In general, either party must have resided in New York State for one year prior to the commencement of the action, provided that certain other criteria are met.
There are still many valid reasons to file for legal separation. However, you do not need to be legally separated to obtain a divorce. This is a common misconception.
An unfit parent may seek an award of custody for the wrong reasons. Many mothers have
historically been the victims of financial tyranny and abuse. Traditionally, the husband has been
the primary breadwinner and the wife may be at a financial disadvantage in matters of litigation.
Child custody can be a crucial issue in any matrimonial or Family Court matter. It will impact the life of your child in many ways. Your child’s residence will shape their daily interactions. Simply put, it will dictate how often you and the other parent see your child.
I represented many victims of domestic violence and abuse. I have also represented many clients who are unfairly and falsely accused of such wrongful acts.
Either parent can seek an award of custody from the court. There is no longer a presumption of
custody to the mother. The “tender years doctrine” in New York State is long gone. The current standard for an award of custody is “best interests of the child” which is gender neutral.
You may be entitled to commence an appeal in the event of an adverse decision in a lower court. We are ready to prepare and argue an appeal on your behalf. We can also help when a favorable ruling is challenged by an opponent.
Grandparents have a statutory right to seek visitation in circumstances where equity would see fit to intervene. The Court will examine whether there is an existing relationship, whether there have been attempts to foster a relationship, and what could reasonably have been done under the circumstances.
I am particularly well-versed in all issues regarding asset protection and high net worth
matrimonial actions. I have successfully represented many high net worth clients in matrimonial actions such as business owners, professionals and investors.
“I highly recommend Philip Kusnetz.
He is professional, honest, and caring. He understands the law and is not afraid to take risks. He puts his client’s needs first, and he is compassionate, knowledgeable, and good listener. When 2 other attorneys told me I would “lose my case” and it was “impossible,” Phil simply said, “When’s your next court date?” “Next week,” was my reply, and “I’ll be ready to win” was his. And win we did. It was long, hard 15 month battle, and sometimes I wanted to give up. But Phil stood by me. Although all odds were against me, as the father, an immigrant, and with a minor conviction (for something I did not do), I won my child custody case with full parental rights to my child. There is no better attorney out there.”
